The STUDIO (Carol Bluestein Photography) will provide photographic coverage in the form of a visual narrative of above event as described below through package choice and proof choice.  For hardcopy PROOFS, the CLIENT (the undersigned) agrees to the use of online proofing, and agrees to open their site to family and guests as soon as they have reviewed and edited their images. Proofs delivered 2-3 weeks from opening of site.

GENERAL TERMS  - Page 2 of 3

ENTIRE AGREEMENT:  This agreement contains the entire understanding between the STUDIO (Carol Bluestein Photography) and the CLIENT (the undersigned). It supersedes all prior and simultaneous agreements between the parties.  The only way to add or change this agreement is to do so in writing, signed by all the parties.  If the parties wish to waive one provision of this agreement, this does not mean that any other provision is also waived.  The party against whom a waiver is sought to be effective must have signed a waiver in writing.

PRE-EVENT CONSULTATION: The parties agree to a pre-event consultation two to three weeks before the event date in order to review actual shooting times, locations, and “image request list.”  Note: STUDIO can not guarantee the taking of any specific pose or picture.

COOPERATION:  The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment.  The STUDIO is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to the STUDIO or missed opportunities due to other people’s camera or flash or delaying actions/activities.  The STUDIO recommends that CLIENT designate an "event guide" to point out important individuals for informal or candid photographs.

OFFICIAL PHOTOGRAPHER: The CLIENT agrees to have the STUDIO as the only official wedding photographer. Simultaneous photographic coverage by another professional photographer (excluding video) releases the STUDIO from this agreement and immediately terminates service. The CLIENT further agrees that no photos posed by STUDIO will be taken by other photographers and assumes the responsibility of same. 

SHOOTING TIME/OVERTIME RATES/ADDITIONS:  The photography schedule and selected methodology are designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by all parties.  The CLIENT and the STUDIO agree that cheerful cooperation and punctuality are therefore essential to that purpose.  Shooting commences at the scheduled start time.  If, at the event, the CLIENT requests more time than the original order includes, the hourly rate on the face of the contract applies.  If overtime is not approved or cannot be accommodated, the STUDIO will terminate coverage at the time specified in the contract (original or as modified), whether or not the event has ended.  The CLIENT is responsible for added production fees and expenses due to conditions imposed by the CLIENT but not revealed at contract inception; e.g. travel expenses due to change of location, event overtime, or additional portrait sessions. The overtime payment is due at the end of the day.

LIMITATIONS: The STUDIO is limited by the guidelines of ceremony officials or location management.  The CLIENT agrees to accept the technical results of such impositions on the STUDIO.  Negotiation with the officials for moderation of guidelines is the CLIENT's responsibility; the STUDIO will offer technical recommendations only. In addition, the STUDIO is not responsible for lack of orlimited coverage due to weather conditions, scheduling complications, or obstructing decorations.

PROOF PREVIEWS:  Proof previews on line are usually ready within 1-2 weeks of the event date. PROOF Delivery is 2-3 weeks after the CLIENT has edited proofs and opened site.

PROOFS:  Proofs are NOT original images or final prints.  Original images are stored by the STUDIO.   Edited proofs have been reviewed and selected by the STUDIO. Minor adjustments/corrections to any image are made at the sole discretion of the STUDIO.  Edited proofs are NOT final prints.  Final Prints are “corrected” through customization and/or the printing process.  Customization is available for an additional fee.  All album prints are custom images and pages may be ordered individually from the STUDIO. 

PROOF CD:  Proof Images on the CD are approximately 1 mg in size: 3.5” x 5” @ 250 dpi.  If CLIENT elects to put images on-line, the image number will match the image numbers online and in the proof book. Underneath each image on the Proof CD (easily cropped off) is a copyright notice.  To duplicate any image at any lab, CLIENT will need a copy of page 3 of this agreement with the STUDIO’s signature.  Again, proofs on the CD are proofs, not final images.

ALBUMS:  Albums take 6-8 weeks and enlargements 2-3 weeks from final approval, except when laboratory and bindery schedules are heavy.  All deliverables are FOB STUDIO and must be claimed within fourteen (14) days. The STUDIO reserves the right to substitute photographic materials (frames, albums, etc.) whenever it is necessary, advisable or mandatory due to manufacturer style, price or color changes.  Additionally, with album covers and pages, minor imperfections and variations in color/texture will occasionally occur.  No guarantee is made in terms of exact color, color-matching or texture.  

ALBUM ORDERS:  Using computerized design techniques, the STUDIO will propose and advise in the layout of album(s); however, all choices by the CLIENT prevail. Album orders will include choice of photographs selected (with special instructions, if any), and these decisions are made following inspection of images. A total of two (2) in-studio album design sessions are included. Additional album design sessions are billed an additional computer design fee of $200 per session. To begin construction of the album(s), a deposit of half of the remaining balance is required, with the balance due upon completion of design and CLIENT approval in writing -- prior to printing.  Absolutely no changes once the final design has been approved.

QUALITY STANDARD, FINAL PRINTS:  The STUDIO’s quality standard target is measured by five guidelines: 1) highlight details are visible, 2) shadow details are visible, 3) whites are clean with no overall color cast, 4) the image has no overall color bias (this does not apply to color balance for lighting conditions),  and 5) flesh tones are believable. Because lighting conditions and movement provide constant challenges, we cannot guarantee the quality of any image.  Variations in color will occasionally occur.  No guarantee is made in terms of exact color.

LIMIT OF LIABILITY:   In the unlikely event that the STUDIO should become injured or too ill to photograph the event, the STUDIO will make every effort to secure a replacement photographer.  If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.  The STUDIO takes the utmost care with respect to storage, transportation and processing of digital images. However, in the unlikely event that images are lost, stolen, or destroyed for reasons within or beyond the STUDIO control, all parties agree that the STUDIO liability is limited to the return of all payments received for the event package.  The limit of liability for a partial loss of images shall be a prorated amount of the package selected, based on the percentage of originals lost.

RETAINER FEEIn the event of a postponement/cancellation, the Retainer Fee is non-refundable.  It shall be liquidated to cover damages to the STUDIO in the event of a breach of contract by the CLIENT.  If the STUDIO is able to re-book the date with a month of cancellation, the Retainer Fee will be refunded, minus a processing fee of $200.  CLIENT shall also be responsible for payment for any STUDIO labor or materials charges incurred up to time of cancellation.  

MEALS:  The CLIENT shall provide a suitable meal (not necessarily the banquet meal served to guests) for the STUDIO (and assistant, if applicable) in the main dining area (so the STUDIO is able to continue working) if the contracted coverage extends through a seated meal service AND the contracted coverage is three or more hours.   If no meal is provided, the STUDIO (and assistant) may obtain own meals off premises at the CLIENT's expense. The STUDIO is not responsible for coverage of any occurrences during the STUDIO’s absence from the main dining/reception.

COPYRIGHTS:  The photographs produced by this STUDIO are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the STUDIO providing explicitly written permission.  The STUDIO owns all copyrights for any and all images produced in connection with this agreement, including the exclusive right to reproduce or publicly display such images. The parties agree that STUDIO may reproduce, publish or exhibit a judicious selection of such photographs as samples of photographic work to be shown to prospective clients, and for instructional or institutional purposes consistent with the highest standards of taste and judgment.  The CLIENT agrees to hold the STUDIO harmless against any and all claims arising from any published images.  

PERSONAL IMAGE USE: In the case where the CLIENT has digital proofs, the CLIENT has the STUDIO’s permission to duplicate images for personal/home use onlyAll publicly displayed/printed images – including the internet -- must have STUDIO written approval and released with the STUDIO appropriately cited for each image. 

PAYMENTS:  The CLIENT agrees to timely payment. Title (possession) of all photographs and albums shall remain with the STUDIO until the CLIENT has paid all outstanding fees.  In event of payment default, the CLIENT is responsible for (but not limited to) ALL bad check fees @ $50/returned check), collection costs, certified mailings, lawyer fees, and court costs.

PRICES: All pricing at the time of contract for albums and prints is honored for three months following the wedding.  Album/print orders will then be subject to current pricing at the time the order is placed.
